Fireworks sales in the Omaha area will be allowed for authorized vendors from Sunday, June 28, through Saturday, July 4. Within the city, using fireworks outside the permitted dates and hours may result in a citation, fines, confiscation of fireworks or arrest.

Omaha allows fireworks from July 2 to July 4

Consumer fireworks may be used in Omaha from Thursday, July 2, through Saturday, July 4, from 12 p.m. to 11 p.m. each day. Outside that window, discharging fireworks may be considered a violation of the city ordinance.

The rule applies within Omaha city limits. Other communities in the metro area may have different hours, so Omaha’s regulations may not match those in Bellevue, Papillion, La Vista, Council Bluffs or other nearby jurisdictions.

Local sales are limited to authorized vendors during the permitted season. In Omaha, sales may take place from June 28 to July 4 with the required permits.

The minimum age to set off fireworks is 16

People who handle or set off fireworks in Omaha must be 16 or older. Minors ages 12 to 15 may do so only under the direct supervision of an adult who is 19 or older.

The age requirement is part of the local and state restrictions that regulate consumer fireworks. Minors outside that age range may not handle fireworks on their own within the city.

OPD will assign officers to respond to complaints

The Omaha Police Department will assign officers to respond to fireworks complaints during the season. Violations of the city ordinance are considered criminal offenses and may result in citations or arrests.

Fines for violating Omaha’s fireworks ordinance are $300 for a first offense, $400 for a second offense and $500 for a third or subsequent offense.

Fireworks may also be confiscated when violations of city rules are found.

Use the non-emergency number for fireworks complaints

Active fireworks complaints should be reported to 402-444-5802, the non-emergency number available for these calls in Omaha and Douglas County.

911 remains reserved for situations involving an immediate threat to life, safety or property. That includes fires, injuries, active damage or emergencies caused by fireworks use.

The non-emergency line allows complaints about noise, use outside permitted hours or illegal discharges to be handled without tying up emergency lines.

Prohibited products and state restrictions

Nebraska allows the sale of approved consumer fireworks, but it maintains restrictions on certain products. M-80s and cherry bombs may not be sold to the public because they exceed the limits allowed for 1.4G fireworks.

Wire sparklers remain prohibited for sale in Nebraska. Flying lanterns are also prohibited for sale, possession and use in the state.

Nebraska also does not allow fireworks to be brought in from other states without the proper license. Products sold to the public must meet state requirements and be approved for retail sale.

Rockets on a stick, including some bottle rockets, may be sold in Nebraska if they are labeled as 1.4G products.
